Safety comes first
KinNearby cannot guarantee a person’s location, safety, route, arrival or access to help. Never rely on it as the only way to request urgent assistance.
1. Agreement and eligibility
These Terms apply to the KinNearby website and native applications. By creating an account or using KinNearby, you agree to these Terms and acknowledge the Privacy Notice. You must be legally able to enter this agreement. A parent or lawful guardian is responsible for authorising and supervising a child’s use where required by law.
2. Accounts and security
Provide accurate account information, protect your password and device, and promptly report suspected unauthorised access. You are responsible for activity through your account unless applicable law provides otherwise. Do not share credentials or impersonate another person.
3. Location sharing and consent
Location sharing is off by default. Start it only with the knowledge and valid consent of affected people and only for a lawful purpose. Circle members and people holding an active journey link may see the latest shared position. Background updates can be delayed or stopped by device settings, battery, connectivity or the operating system. You can pause sharing or end a journey at any time.
4. Acceptable use
Do not use KinNearby to stalk, harass, intimidate, exploit, discriminate, unlawfully monitor, facilitate violence, evade lawful authorities, publish another person’s location, submit malicious reports, probe security, scrape private data or introduce harmful code. Do not pressure anyone to share a location. We may restrict or terminate access and preserve or disclose records where reasonably necessary to protect people, investigate abuse or comply with law.
5. Driving and safety
Do not interact with KinNearby while driving or moving. Use a safely stopped device or ask a passenger. Routes, locations, arrival estimates, venue details, road reports and alerts may be inaccurate, delayed or unavailable. Obey official signs, road rules and lawful directions. KinNearby is not an emergency, medical or security service. Call 000 in Australia or the local emergency number when immediate help is required.
6. User content and permissions
You keep ownership of content you submit. You grant KinNearby the limited permission needed to host, process and display that content to provide, secure and improve the service. You confirm that you have the rights and consents required for information you submit, including profile images, circle details, locations, ratings and reports.
7. Shop Circles and transactions
Shop Circles are web-only marketplace tools for independent sellers and buyers. The seller identified on a storefront, not KinNearby, sells and fulfils each product. Sellers are responsible for lawful listings, pricing, GST, tax invoices, product safety, delivery and consumer remedies. Card payments and seller payouts are processed by Stripe; cash is handled directly with the seller. The Marketplace Terms form part of these Terms for every shop listing, order, payment, delivery, refund and dispute.
7. Third-party services
KinNearby relies on providers for authentication, hosting, maps, routing, traffic, weather, email and device services. Their data and services may be unavailable or subject to separate terms. KinNearby does not control and is not responsible for third-party services, user conduct or external links.
8. Availability and changes
We may change, suspend or discontinue features to maintain security, comply with law or improve the service. We aim to give reasonable notice of material changes where practicable, but do not promise uninterrupted availability or preservation of every feature.
9. Account deletion and termination
You may delete your account in the native app. Deletion permanently removes active account data and circles you own, subject to backups, security records and legal retention described in the Privacy Notice. We may suspend or terminate accounts for serious or repeated violations. Provisions that by their nature should survive termination continue to apply.
10. Disclaimers and liability
To the maximum extent permitted by law, KinNearby is provided as is and as available without guarantees of accuracy, availability, security or fitness for a particular purpose. Nothing excludes rights that cannot legally be excluded, including applicable Australian Consumer Law rights. To the extent lawful, KinNearby is not liable for indirect or consequential loss or for harm caused by user conduct, inaccurate location, connectivity, device behaviour or third-party services.
11. Governing law and contact
These Terms are governed by the laws applicable in Victoria, Australia, without excluding mandatory rights available where you live. Before formal proceedings, please submit a support or privacy request so the issue can be assessed. Privacy questions and complaints can be submitted through the tracked form linked below.
These Terms should be reviewed by a qualified lawyer for the operator’s circumstances and every jurisdiction in which KinNearby is offered.
