Know who you are buying from
Each storefront identifies its independent seller. Review its fulfilment and refund information before ordering. Your mandatory consumer rights continue to apply.
1. How Shop Circles work
Shop Circles let independent sellers list products and accept pickup or delivery orders on the KinNearby website. KinNearby provides the listing, order, payment and delivery-tracking tools. The seller identified on the storefront is the merchant and contracting party for each sale; KinNearby does not own, inspect or fulfil listed products.
2. Seller eligibility and information
A seller must have authority to trade, provide an accurate legal or trading name and support email, disclose an ABN where applicable, keep product and availability information current, and complete any identity, business and bank verification required by Stripe. Sellers must hold registrations, permits, insurance and licences required for their products and locations.
3. Listings and pricing
Sellers are responsible for descriptions, images, prices, stock, allergens, safety warnings and claims. Displayed prices are in Australian dollars and must include GST where the seller indicates GST applies. Sellers are responsible for GST registration, tax invoices, reporting and other taxes. KinNearby does not provide tax advice.
4. Orders
An order is submitted when the buyer confirms checkout. A card order is not paid until Stripe reports successful payment. Cash remains payable directly to the seller. For PayID orders, the buyer must transfer the exact amount to the displayed PayID using the unique order reference, and the seller must confirm cleared funds in its bank account before fulfilment. Sellers may reject or cancel an order they cannot fulfil and must promptly tell the buyer. Buyers must provide accurate delivery and contact information and must not place fraudulent or speculative orders.
5. Card payments and payouts
Card payments are processed by Stripe under Stripe's terms and privacy policy. A seller must maintain an eligible Stripe connected account. Stripe may hold, delay, reverse or refuse payments or payouts for compliance, fraud, dispute or risk reasons. Any KinNearby platform fee is disclosed through the applicable seller arrangement; Stripe processing fees may also apply. KinNearby does not store full card numbers.
5A. PayID payments
PayID is a direct bank transfer between the buyer and seller, not a Stripe or KinNearby payment service. KinNearby displays the seller-provided PayID, amount and order reference but cannot verify the PayID account name or automatically confirm settlement. Sellers must check their own bank records before marking an order paid. Buyers should verify the recipient name shown by their bank before sending funds and contact the seller about incorrect, duplicate or missing transfers.
6. Pickup, delivery and risk
The seller is responsible for pickup instructions, packaging, delivery, handover and any courier it chooses. Delivery locations and live tracking may be delayed or inaccurate and do not prove delivery. Risk and title pass as required by applicable law and the seller's disclosed terms. Buyers should inspect products promptly and contact the seller using the storefront support address.
7. Cancellations, returns and refunds
The seller's displayed policy applies in addition to rights that cannot be excluded. Nothing limits guarantees or remedies under the Australian Consumer Law. Sellers must provide a remedy when legally required, including for faulty, unsafe, materially misdescribed or unfit products. Approved card refunds are returned through Stripe to the original payment method and can take time to appear. Cash and PayID refunds are handled directly by the seller and must not be marked complete until the seller has sent them.
8. Prohibited products and conduct
Sellers must not list illegal, stolen, unsafe, recalled, counterfeit or infringing goods; weapons; controlled drugs; regulated medicines; tobacco or vaping products; adult sexual services; live animals; financial products; or goods requiring licences or age checks that the seller cannot lawfully provide. Users must not manipulate ratings, payments, refunds, delivery tracking or access links. KinNearby may remove listings, restrict shops, preserve records or report conduct where reasonably necessary.
9. Disputes and chargebacks
Buyers should first contact the seller and keep relevant order evidence. Sellers must respond within a reasonable period. A cardholder may also have rights through Stripe or their card issuer. Sellers are responsible for valid refunds, chargebacks, fees and negative balances arising from their sales unless law requires otherwise. KinNearby may share necessary order records with Stripe, banks, authorities or parties resolving a dispute.
10. Privacy and records
Shop use is also governed by the Privacy, Safety and Responsible Use Statement. Sellers may use buyer names, addresses and order information only to fulfil orders, provide support, meet legal duties and resolve disputes. They must protect that information and must not use it for unrelated marketing without lawful permission.
11. Platform availability and liability
Shop tools are provided as is and may be changed, restricted or unavailable. To the maximum extent permitted by law, KinNearby is not responsible for seller conduct, product quality, stock, tax, fulfilment, delivery, loss caused by inaccurate listings, or Stripe and banking services. Nothing excludes liability or a right that cannot lawfully be excluded.
12. Relationship with other terms
These Marketplace Terms supplement the KinNearby Terms of Service. If they conflict for a Shop Circle transaction, these Marketplace Terms apply to that transaction. Victorian law applies subject to mandatory consumer rights elsewhere. Questions or disputes may be submitted through the privacy and support form.
